' <br /> <br />1. Backeround <br /> <br />In 1995, the City ofRoseville constructed the section of Lincoln Drive, between Terrace <br />Drive and County Road C-2, completing Lincoln Drive rrom County Road C to Lydia. <br />With the completion of this street, the West Snelling Avenue Frontage Road was no <br />longer needed to provide access to the properties south of County Road C-2 and as a part <br />of the construction project, the roadway was removed. Consistent with past practice, <br />since the right-of-way for that road is no longer needed by the City, the City is proposing <br />to vacate that right-of-way to adjacent property owners. These owners include the <br />Benjamin's Restaurant, Room and Board, Countryside Restaurant, Health East, and <br />Lido's. Attached to this report are five draft resolutions vacating that portion of the <br />Snelling Avenue Frontage Road right-of-way to the respective land owners. While the <br />City is proposing to vacate this right-of-way to these property owners, the 20 foot light <br />rail and utility easement over the east 20 feet of the property, will remain. <br /> <br />1. The Planning Commission, at the March 13, 1996 meeting, unanimously <br />recommended approval of the City's request to vacate the right-of-way for the W. <br />Snelling Avenue Frontage Road, between County Road C-2 and Terrace Drive. <br /> <br />Staff Recommendation: <br /> <br />1. With the completion of the Lincoln Drive project, between Terrace Drive and County <br />Road C-2, and the removal of the West Snelling Avenue Frontage Road road bed, the <br />right-of-way for the rrontage road is no longer necessary. The City Attorney has requested <br />additional time to review legal descriptions and other aspects of this vacation. Due to the <br />importance of this matter, staff would agree with that recommendation. <br /> <br />Council Action Requested: <br /> <br />1. Motion to approve continuation of the City ofRoseville's request to vacate the right-of- <br />way for the W.
