<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 5-28-96 <br /> <br />Department Approval: <br /> <br />~/"f <br /> <br />ITEM NO.: G-5 <br /> <br />Manager Reviewed: Agenda Section: <br /> <br />(~ct7 Hearing <br /> <br />Bruce Kath request for a rezoning, conditional use permit, preliminary plat, and <br />amendment to the Comprehensive Plan at 1912 Lexington Avenue to construct a <br />gas station/convenience store/car wash. <br /> <br />Item Description: <br /> <br />Background <br /> <br />Bruce Kath is proposing to construct a gas station/convenience store with a car wash at 1912 Lexington <br />Avenue. The site is in the southeast quadrant of the intersection of Lexington Avenue and RoselaWll <br />Avenue. The site is currently occupied by Ace's 66 Service Station and automobile repair and a single <br />story building at 1080 RoselaWll Avenue, currently occupied by a real estate firm. If approved, the <br />proposed uses will replace the existing uses on the site. The service station building was constructed <br />about 1932 and the other commercial building was constructed in about 1956. The property is <br />bordered on the north by RoselaWll Avenue, on the west by Lexington Avenue, on the south by 22 <br />housing units within 2 apartment buildings, and on the east by single family residential land uses. <br />Across (north) RoselaWll Avenue is Suburban Hardware and the newly approved 16 townhomes of <br />Rose Villa. Across Lexington Avenue (west) is the ReMax Realty building. <br /> <br />At the March 13, 1996 meeting, the Planning Commission continued the public hearing on the Bruce <br />Kath request for a rezoning, conditional use permit, and preliminary and final plat at 1912 Lexington <br />A venue to expand the hearing to include a comprehensive plan amendment as well. In order to address <br />the proposed Comprehensive Land Use Guide Plan amendment and to modify the development <br />proposal based on concerns raised at the March meeting, the applicant requested a continuation until <br />the May 8, 1996 meeting. <br /> <br />Development Summary <br /> <br />The property under consideration is zoned B-3 General Business, B-2 Retail Business, and B-1 Limited <br />Business. An automobile service station and car wash is a use permitted by conditional use permit in <br />the B-2 and B-3 districts but is not permitted in the B-1 district. The applicant is requesting a rezoning <br />of the entire site to B-2 Retail Business and a conditional use permit for a service station store with a <br />car wash. The City's Comprehensive Land Use Guide Plan has the majority of the property designated <br />as business purposes. The northeast comer of the property (that area zoned B-1 Limited Business) is <br />designated low density residential in the Comprehensive Land Use Guide Plan. If the project is to be <br />approved, the designation in this area of the Comprehensive Plan would need to be changed to <br />Business. <br /> <br />As originally proposed, the project would involve the demolition and removal ofthe existing structures <br />and tanks on the site and the construction of a new 6500 square foot service station store and car wash. <br />The car wash would occupy approximately 2000 square feet of the 6500 square foot building.
