<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />ofRoseville, County of Ramsey, Minnesota, was duly called and held at the City Hall on <br />Tuesday, the 28th day of May, 1996, at 6:30 p.m. <br /> <br />The following members were present: <br />and the following were absent: <br /> <br />Member <br /> <br />introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT, REZONING, AND <br />PRELIMINARY PLAT FOR BRUCE KATH TO CONSTRUCT A GAS <br />STATION/CONVENIENCE STORE/CAR WASH AT 1912 LEXINGTON AVENUE. <br /> <br />WHEREAS, pursuant to Minnesota Statutes 462.357, the City of Roseville has adopted <br />zoning regulations to control land uses throughout the City; and <br /> <br />WHEREAS, said regulations provided that a motor fuel station may be allowed within <br />the confines of a B-2 and B-3 retail zoning district as a conditional use but is not allowed in the <br />B-1 zoning district; and <br /> <br />WHEREAS, approval of a conditional use permit, rezoning, and preliminary plat for a <br />motor fuel station has been requested by Bruce Kath; and <br /> <br />WHEREAS, the Roseville Planning Commission held a public hearing and recommended <br />approval of such rezoning, conditional use permit, and preliminary plat subject to certain <br />conditions on May 8, 1996; and <br /> <br />WHEREAS, the Roseville City Council considered such conditional use permit, <br />rezoning, and preliminary plat at a public hearing held on May 28, 1996. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council ofthe city of Roseville, <br />Minnesota, Ramsey County, Minnesota, that a conditional use permit, rezoning and preliminary <br />plat for a motor fuel station within a B-2 zoning district be approved subject to the following <br />conditions: <br /> <br />1. Exterior materials shall be of one consistent design and finish on all four sides, with the <br />predominate material brick, the trim materials color impregnated break-off block and <br />metal. <br />
