As you know, Lake Owasso lies partially within the cities of Shoreview and Roseville, <br />and because of this, water surface use regulations may only be adopted pursuant to a joint <br />powers agreement between the two cities. Therefore, the Shoreview 150 foot setback adopted <br />in 1994 does not apply to Lake Owasso. As this amendment had no effect with regard to Lake <br />Owasso, the current no-wake setback is 300 feet as provided for in the Roseville ordinance <br />which enjoys "grandfather" status because it predates the state's regulations on water surface use <br />management. <br /> <br /> <br />I spoke with Maureen Janke, an attorney at the Department of Natural Resources <br />specializing in water surface use management, and she agreed that the current no-wake setback <br />for Lake Owasso is 300 feet. She did, however, indicate that it is the position of the DNR that <br />all lakes within the state should come into compliance with the 100 or 150 foot no-wake setback <br />mandated by Mirinesota Rules Section 6110.3700, subpart 7.
