ACTION <br /> <br />DATE: 12-05-95 <br /> <br />ITEM NO.: G- 2 <br /> <br />Department Approval: <br /> <br />Manager Reviewed: <br /> <br />Agenda Section: <br /> <br />Item Description: <br /> <br />Hearings <br />Approval of an ordinance amendment to Chapter 702 of the RoseviUe City <br />Code concerning regulation and use of the public waters ofLalce Owasso <br />and an amended Joint Powers Agreement with the City ofShoreview. <br /> <br />Batkaround <br /> <br />1. <br /> <br />At the October 12, 1995 Work Session, the City Council discussed an amendment to the <br />Joint Powers Agreement with the City of Shoreview concerning the use and regulation of <br />public waters of Lake Owasso. The City of Shoreview amended their ordinance to include <br />150 foot no-wake zone. This requirement is not consistent with the City ofRoseviJle's <br />300 foot requirement which makes enforcement difficult. To correct this problem, City <br />staff has worked with the City Attorney's office to make the appropriate amendments to <br />the existing Joint Powers Agreement with Shoreview concerning the use of Lake Owasso, <br />as well as an amendment to Chapter 702 of the City Code. The City of Shore\iew has <br />approved the attached amended Joint Powers Agreement for Lake Owasso water surface <br />use as drafted by Mitch Converse of the City Attorney's office. <br /> <br />. <br /> <br />. <br /> <br />2. The existing Joint Powers Agreement, is proposed to be amended in two ways: <br /> <br />a. Language is added to the agreement setting forth a 150 foot no-wake zone with <br />the exception of straight out departure and straight in return to shore and <br />motorized water craft activity associated with a special event approved by the <br />Ramsey County Sheriff. <br /> <br />b. The section concerning signage is amended to be consistent with State law. This <br />would require that all lake use rules be posted at each public boat access <br /> <br />3. At the October 23, 1995 meeting, the City Council approved the concept and set <br />November 13, 1995 as the public hearing date concerning this amendment. <br /> <br />4. The Lake Owasso Home Owners Association has been sent copies of this report for their <br />review and comment. <br /> <br />Altemative Adions : <br /> <br />1.
