Stat. ~15.99, Subd. 3 (f) provides as follows: <br /> <br />.. an agency may extend the time line under this <br />subdivision before the end of the initial 60 day period by <br />providing written notice of the extension to the applicant. <br />The notification must state the reason for the extension and <br />its anticipated length, which may not exceed 60 days unless <br />approved by the applicant." <br /> <br />Thus, we can extend the 60 days by an additional 60 days by sending <br />a notice. The statute is silent on who sends the notice. I think <br />if at all possible, I would like to see the council actually make <br />a motion directing that the extension is made. Obviously, if we <br />go beyond an additional 60 days or 120 days we must get the okay of <br />the applicant. <br /> <br />There are still many, many unanswered questions regarding this new <br />statute.
