<br />SECTION 10 - WORK COMPLETION AND PAYMENTS <br /> <br />10.1 CHANGES IN THE WORK <br /> <br />Without invalidating the Contract, the Owner, through the Engineer, <br />may order changes in, additions to and deductions from the work. Any <br />adjustments in Contract costs or time of completion caused by such <br />changes shall be made at the time of ordering such change. The <br />Engineer may, during the life of the Contract, issue additional <br />instructions necessary to illustrate changes in the work. <br /> <br />The Engineer shall have the authority to make minor changes in the <br />work not involving extra cost and not inconsistent with the overall <br />intent of the Contract Documents. These may be accomplished by a <br />Field Order. If the Contractor believes that any minor change or <br />alteration authorized by the Engineer entitles him to an increase <br />in the Contract Price, he may make a claim therefore as provided in <br />Section 10.2. <br /> <br />Additional work performed by the Contractor without authorization <br />of a Change Order will not entitle him to an increase in the Contract <br />Price or an extension of the Contract Time, except in the case of <br />an emergency as provided in Section 8. <br /> <br />The Owner will execute any appropriate Change Order prepared by the <br />Engineer covering changes in the work to be performed, work performed <br />in an emergency, and any other claim of the Contractor for a change <br />in the Contract Time or the Contract Price which is approved by <br />the Engineer. <br /> <br />It shall be the Contractor's responsibility to notify his Surety of <br />any change in the Contract Price or any changes affecting the general <br />scope of the Work and the amount of the applicable Bonds shall be <br />adjusted accordingly. The Contractor will furnish proof of such <br />adjuscment to the Owner. <br /> <br />10.2 CHANGE OF CONTRACT PRICE <br /> <br />The Contract Price constitutes the total compensation payable to the <br />Contractor for performing the work. All duties, responsibilities and <br />obligations assigned to or undertaken by the Contractor shall be at <br />his expense without change in the Contract Price. <br /> <br />Should the number of units of completed work of any item included in <br />the Unit Price schedule classified as a major item vary more than 2at <br />from the number of units stated in said schedule, either the Owner or <br />the Contractor may request a revision of the unit price for the item <br />so affected. Under such conditions adjustment of the price, if any, <br />shall be made in accordance with this Section. A major item under the <br />meaning of this provision is defined as any item equal to or greater <br />than lot of ~he total price for the entire contract. <br /> <br />The Contract Price may only be changed by a Change Order. If the <br />Contractor is entitled by the Contract Documents to make a claim <br />for an increase in the Contract Price, his claim shall be in <br />writing delivered to the Owner. and the Engineer within 15 days of <br />the occurence of the event giving rise to the claim.
