<br />14.7 CLAIMS FOR EXTRA COST <br /> <br />The Contractor may submit a Claim for Extra Cost for work ordered <br />after the date of the Contract. Any such Claim shall be made to <br />the Engineer in writing within seven (7) days after the receipt of <br />instrUctions and before proceeding to execute the work except in an <br />emergency endangering life or property. The Engineer's decision <br />shall be made within seven (7) days after receipt of any Claim for <br />.Extra Cost. Denial of a Claim shall be by letter and approval shall <br />be by a written Change Order. <br /> <br />14.8 DISCREPANCIES, ERRORS, OMISSIONS <br /> <br />If the Contractor, during the course of his work, discovers any <br />discrepancy between the plans and the physical condition of the <br />project site, or any errors or omissions in the plans or in given <br />survey points and instructions, he shall immediately inform the <br />Engineer in writing, and the Engineer shall promptly verify the <br />same. Any work done by the Contractor after such discovery, until <br />authorized, will be done at his risk. <br /> <br /> <br />14.9 INDEMNIFICATION <br /> <br />I.'': <br /> <br />The Contractor shall indemnify and hold harmless the Owner and the <br />Engineer and their agents and employees from and against all claims, <br />damages, losses and expenses including attorneys' fees arising out <br />of or resulting from the performance of the work, provided that any <br />such claim, damage, loss or expense (a) is attributable to bodily <br />injury, sickness, disease or death, or to injury to or destruction <br />of tangible property (other than the work itself) including the loss <br />of use resulting therefrom and (b) is caused in whole or in part by <br />any negligent act or omission of the Contractor, any Subcontractor, <br />anyone directly or indirectly employed by any of them or anyone for <br />whose acts any of them may be liable, regardless of whether or not <br />it is caused by a party indemnified hereunder. <br /> <br />The obligations of the Contractor under this Section 14.9 shall not <br />extend to the liability of the Engineer, his agents or employees <br />arising out of the preparation or approval of maps, drawings, opinions, <br />reports, surveys, Change Orders, designs or specifications. <br /> <br /> <br />If any and all claims against the Owner or the Engineer or any of <br />their agents or employees by any employee of the Contractor, any <br />Subcontractor, anyone directly or indirectly employed by any of them <br />or anyone for whose acts any of them may be liable, the indemnification <br />obligation under this Section 14.9 shall not be limited in any way <br />by any limitation on the amount or type of damages, compensation or <br />benefits payable by or for. the Contractor or any Subcontractor under <br />Workmen's Compensation acts, disability benefit acts or other employee <br />benefit acts. <br /> <br />GC-20 <br /> <br />
