<br />14.4 <br /> <br />J <br /> <br />~J <br /> <br /> <br />14.3 SUBSOIL CONDITIONS AND CONDITIONS OF THE SITE <br /> <br />It shall be the Contractor's responsibility to determine subsoil <br />conditions prior to submitting his bid, regardless of any verbal or <br />written information which may be furnished by the Owner ~r Engineer. <br /> <br />The Contractor shall become familiar with all conditions of the site <br />prior to submitting his bid proposal. Submission of a proposal shall <br />be considered as evidence that the bidder is familiar with the site <br />and understands all the conditions of the site affecting the work and <br />all else that is required to complete the work in accordance with the <br />Contract Documents. <br /> <br />ASSIGNMENT <br /> <br />The Contractor shall not assign the Contract or sublet it as a whole <br />or in part without the written consent of the Owner, nor shall the. <br />Contractor assign any monies due or to become due to him hereunder, <br />without the previous written consen~ of the Owner. Assigning or <br />subletting the Contract shall not relieve the Contractor or his <br />surety from any Contract obligation. <br /> <br /> <br />14.5 VERBAL AGREEMENTS <br /> <br />14.6 <br /> <br />.1 <br />J <br />.1 <br />J <br />J <br />J <br />J <br />,J <br /> <br />No verbal agreement with any officer, agent or employee of the Owner <br />before or after execution of this Contract shall affect or modify <br />any of the terms or obligations contained in any of the Contract <br />Documents. <br /> <br />WAIVERS OF CLAIHS AND CONTINUING OBLIGATIONS <br /> <br />The Contractor is obligated to perform the work and complete the <br />project in accordance with the Contract Documents and none of the <br />following shall constitute an acceptance of work not in accordance <br />with the Contract Documents: <br /> <br /> <br />1) Approval of any partial or final payment by the Engineer. <br /> <br />2) Any payment by the Owner to the Contractor under the Contract <br />Documents. <br /> <br />3) Any use or occupancy of the project or any part thereof by the <br />Owner. <br /> <br />4) Any correction of defective work by the Owner. <br /> <br /> <br />The preparation and acceptance of final payment will constitute a <br />waiver of all claims by the Owner against the Contractor accept those <br />arising from unsettled liens, from faulty or defective work appearing <br />after final payment or from failure Co comply with. the requirements <br />of the Contract Documents, and will constitute a waiver of all claims <br />by the Contractor against the Owner accept those previously made in <br />writing and still unsettled. <br />
