Disregard of this provision shall be cause for suspension of the project until the Contractor can show evidence that men have hired specifically to perform the above work and will be on the project at all times. Streets in the area not under construction, shall be kept free of construction materials, dirt, and other undesirable material. Where materials or debris have washed or flowed into or have been placed in ditches, gutters, drains, catch basins or elsewhere as a result of the Contractor's operations, such material or debris shall be removed and satisfactorily disposed of during progress of the work.. All ditches, channels drains, etc., shall be kept clean and neat conditions. 25. GUARANTEE A. The Contractor shall guarantee all work relating to utilities and streets including appurtenances, concrete curb and gutter, materials and equipment furnished by him. All work shall be guaranteed for a period of one year trom the date of written acceptance of the work. After completion of the bituminous base course, the wearing course shall be placed the following construction season. The contractor shall guarantee all work related to streets for a period of two years from the date of written acceptance of the wearing course. B. The Contractor's performance bond shall assure the Contractor's performance of these guarantee provisions including the maintenance requirements. The City of Roseville shall be named on the maintenance portion of the required bond or a separate maintenance bond shall be provided to the City by the Contractor. 26. BONDS The Contractor shall furnish the Owner an acceptable performance bond in the full amount of the contract prior to commencing work. Prior to final acceptance of the work by the Owner, the Contractor shall furnish to the Owner/City, an acceptable one year maintenance bond guaranteeing the work as specified for one year from the date of acceptance by the City Council. Upon notice, the Contractor shall promptly replace or repair any defective work or materials to the satisfaction of the Engineer and the City. Upon the Contractor's failure to make said replacements or repairs within ten days of written notice the Owner/City may perform the necessary work or repairs with all expenses incurred therein to be assumed by the Contractor and his sureties. 27. PAYMENT Estimates of work completed will be prepared by the Engineer on or about the 30th day of each month for all work completed to the 20th day of the month, less 10% to be retained -7-
