<br />Disregard of this provision shall be cause for suspension of the project until the Contractor <br />can show evidence that men have hired specifically to perform the above work and will be <br />on the project at all times. <br /> <br />Streets in the area not under construction, shall be kept free of construction materials, dirt, <br />and other undesirable material. <br /> <br />Where materials or debris have washed or flowed into or have been placed in ditches, <br />gutters, drains, catch basins or elsewhere as a result of the Contractor's operations, such <br />material or debris shall be removed and satisfactorily disposed of during progress of the <br />work.. All ditches, channels drains, etc., shall be kept clean and neat conditions. <br /> <br />25. GUARANTEE <br /> <br />A. The Contractor shall guarantee all work relating to utilities and streets including <br />appurtenances, concrete curb and gutter, materials and equipment furnished by him. All <br />work shall be guaranteed for a period of one year trom the date of written acceptance of <br />the work. After completion of the bituminous base course, the wearing course shall be <br />placed the following construction season. The contractor shall guarantee all work related <br />to streets for a period of two years from the date of written acceptance of the wearing <br />course. <br /> <br />B. The Contractor's performance bond shall assure the Contractor's performance of these <br />guarantee provisions including the maintenance requirements. The City of Roseville <br />shall be named on the maintenance portion of the required bond or a separate <br />maintenance bond shall be provided to the City by the Contractor. <br /> <br />26. BONDS <br /> <br />The Contractor shall furnish the Owner an acceptable performance bond in the full amount <br />of the contract prior to commencing work. <br /> <br />Prior to final acceptance of the work by the Owner, the Contractor shall furnish to the <br />Owner/City, an acceptable one year maintenance bond guaranteeing the work as specified <br />for one year from the date of acceptance by the City Council. Upon notice, the Contractor <br />shall promptly replace or repair any defective work or materials to the satisfaction of the <br />Engineer and the City. Upon the Contractor's failure to make said replacements or repairs <br />within ten days of written notice the Owner/City may perform the necessary work or <br />repairs with all expenses incurred therein to be assumed by the Contractor and his sureties. <br /> <br />27. PAYMENT <br /> <br />Estimates of work completed will be prepared by the Engineer on or about the 30th day of <br />each month for all work completed to the 20th day of the month, less 10% to be retained <br />-7- <br /> <br /> <br /> <br />
