<br />directly or indirectly employed by them, as he is for the acts and <br />omissions of persons directly euployed by him. <br /> <br />Nothing contained in the contract documents shall create any <br />contractual relation between the subcontractor and the Owner. <br /> <br />7.4 USE OF COHPLETED PORTIONS <br /> <br />The owner may, at any time during progress of the work, take over <br />and place in service any completed portions of the work which are <br />ready for service, even though the entire work of the contract is <br />not fully completed. Such taking of possession by the owner shall <br />not be deemed an acceptance of any other portion of the work, nor <br />of any work not completed in accordance with the contract documents. <br />If such prior use increases the cost of or delays the work, the <br />Contractor shall be entitled to such extra compensation, or extension <br />of time, or both as determined by the Engineer. <br /> <br />7.5 CONTRACTORS RESPONSIBILITY FOR WORK <br /> <br />The work under Contract shall be under the charge and care of the <br />Contr~ctor until acceptance, and he shall take every precaution <br />within his power to prevent damage to work during this contract. <br /> <br />The Contractor shall repair, rebuild, restore, and make good all <br />damages to all portions of the work constructed by htm before its <br />completion and acceptance, and he shall bear the expense thereof <br />except as otherwise expressly provided elsewhere in the contract. <br /> <br />SKCTION 8 <br /> <br />PROTECTION OF THE PUBLIC AND OF WORK AND PROPERTY <br /> <br />The Contractor shall provide and maintain all necessary watchmen, <br />barricades, red lights and warning signs and take all necessary <br />precautions for the protection of the public. He shall maintain <br />adequate protection of all work from damage, and shall take all <br />precautions to protect property from injury or loss arising in <br />connection with this Contract. He shall make good any damage, <br />injury or loss to his work and to property resulting from lack of <br />protective precautions. He shall adequately protect private and <br />public property, including surface and subsurface features and <br />structures and shall satisfy all claims from damage to property or <br />for trespass. <br /> <br />In emergencies affecting the safety of persons or the work or property <br />at the site or adjacent thereto, the Contractor, without special <br />instruction or authorization from the Engineer or Owner, is <br />obligated to act, at his discretion, to prevent threat~ned damage, <br />injury or loss. <br /> <br />GC-8 <br /> <br /> <br /> <br />....j <br /> <br />I <br />, <br />
