<br />I <br /> <br />SUl:eested Council Action: <br /> <br />1. Motion to approve a resolution approving Ryan Construction Company of Minnesota, <br />Inc.'s request for a side comer parking setback variance of 40 feet at 2778 N. Cleveland <br />Avenue for the construction of an office/warehouse facility for the following reasons: <br /> <br />a) The site is surrounded on three sides by street right-of-way. This condition results <br />in a 40 foot parking setback requirement on 3 sides of the property (and an 80 foot <br />or more building setback) which limits the developable area of the site. <br /> <br />b) The developers are contractually obligated by the development agreement with <br />the city to provide 105,000 sq. feet of building on the site. <br /> <br />c) There is a potential need for additional right-of-way or easements for future <br />development of Twin Lakes Parkway. This would reduce the developable area of <br />the site. <br /> <br />d) Mount Ridge Road is an unimproved right-of-way which may not be necessary in <br />the future. There are alternative design options available to provide access for <br />future development sites in the area. <br /> <br />and with the following variance conditions: <br /> <br />a) The developer provide the city with right-of-way and easements necessary along <br />lona Lane for future roadway, utility, entry signs, street trees consistent with the <br />Twin Lakes Parkway Design Standards; and the City Street Tree Master Plan <br />Policy, pedestrian pathways, and other pedestrian amenities for the entire site. <br /> <br />b) The developer and the City enter into an agreement which allows the developer to <br />use portions of the unimproved right-of-way of Mount Ridge and lona Lane for <br />temporary ponding and landscaping purposes. <br /> <br />c) The developer and the City enter into a separate assessment agreement which <br />requires the developer to pay for any additional land acquisition costs incurred by <br />the City along the Ryan project frontage on lona, should the City decide to <br />construct Mount Ridge Road in the future. <br /> <br />2) Motion to direct staff to study and provide alternative standards and procedures for <br />review of development within the Twin Lakes Redevelopment area. <br /> <br />Staff Report by: Michael Falk <br /> <br />8 <br />
