<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly called held at the City Hall on Tuesday, the 25th day <br />of June, 1996 at 6:30 P.M. <br /> <br />The following members were present: <br />and the following were absent: <br /> <br />Member <br /> <br />introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. <br /> <br />RESOLUTION APPROVING RYAN COMPANIES REQUEST FORA VARIANCE AT 2778 N. <br />CLEVELAND AVENUE. <br /> <br />WHEREAS, Roseville City Code Section 1007.01AI requires that parking between buildings <br />and public streets must be setback at least 40 feet from property lines adjacent to public streets in 1-2 <br />zoning districts; and <br /> <br />WHEREAS, Ryan Companies has requested a variance to allow a zero parking setback adjacent <br />to the unimproved Mount Ridge Road; and <br /> <br />WHEREAS, the Roseville Planning Commission recommended approval of such variance on <br />May 8, 1996 subject to the following conditions: <br /> <br />I. That the developer provide to the City right-of-way and easements as necessary for <br />future roadway, utilities, entrance monument signs, street trees consistent with the Twin <br />Lakes Design Standards, and the City Street Tree Master Plan Policy, pedestrian <br />pathways, and other pedestrian amenities; and <br /> <br />2. The developer and the City enter into an agreement which allows the developer to use <br />portions of the unimproved right-of-way of Mount Ridge and Iona Lane for temporary <br />access, ponding, and landscaping purposes. <br /> <br />WHEREAS, the Roseville City Council conducted a public hearing on the requested variance <br />on June 25, 1996; and <br /> <br />WHEREAS, the Roseville City Council has found that there are practical difficulties and <br />hardships present on this site including: <br /> <br />1. The site is surrounded on three sides by street right-of-way. This condition results in a <br />40 foot parking setback requirement on three sides of the property (and an 80 foot or <br />more building setback) which limits the developable area of the site. <br /> <br />2. The developer is contractually obligated by development agreement with the City to <br />provide 105,000 square feet of building on the site. <br /> <br />3. There is a potential need for additional right-of-way or easements for the future <br />development of Twin Lakes Parkway. This will further reduce the developable area of <br />the site; and <br />
