<br />REQUEST FOR COUNCIL ACTION <br /> <br />Item Description: <br /> <br />DATE: 8/26/96 <br /> <br />ITEM NO.: H-4 <br />Manager Reviewed: Agenda Section: <br /> <br />~J...- Hearing <br />Dennis Batty/Roseville Covenant Church request for preliminary and final <br />plat approval, vacation of utility and walkway easements, and a 16-1/2 <br />foot height variance from the R-l zoning district requirement of30 feet for <br />their building at 2865 Hamline Avenue North. <br /> <br />Department Approval: <br /> <br />Backaround: <br /> <br />Roseville Covenant Church proposes to construct a new church complex at 2865 Hamline <br />Avenue North. The site is 4.5 acres in size and is bounded on the east by Hamline Avenue, on <br />the north by County Road C-2 and on the south by Centennial Drive. Of the 4.5 acres, the east <br />halfis zoned R-l Single Family and is guided for low density residential development in the <br />City's Comprehensive Land Use Guide Plan. The west half fronting along Centennial Drive is <br />zoned B-1 Limited Business and is guided for business uses in the Comprehensive Land Use <br />Guide Plan. The property currently consists of 4 separate lots. A part of the application is for a <br />preliminary and fmal plat consolidating these lots into a single parcel of land and abandoning <br />utility easements and a 5 foot wide walkway easement that are no longer required. The proposed <br />use of the land is for an approximate 30,300 square foot church with a sanctuary design to seat <br />400 and a parking lot for 183 cars. <br /> <br />Roseville Covenant Church is currently located in the northwest comer of Hamline Avenue and <br />County Road C. They have outgrown their current facilities and are proposing to build a new <br />facility on the property located at Hamline and Centennial Drive that they have owned for some <br />time. <br /> <br />City Code Requirements: <br /> <br />Section 1004.02, Subsection A4, of the Roseville Zoning Code calls out churches as permitted <br />uses in the R-l Single Family Zoning District. Section 1004.02, Subsection D3, indicates that no <br />structure or building shall exceed 30 feet in height in this zoning district. Section 1005.02 allows <br />churches by conditional use permit in B-1 zoning classifications. This section also allows off- <br />street parking as permitted accessory uses in a B-1 zoning district. <br /> <br />These sections of the Roseville Zoning Code are inconsistent and confusing. It is staff's <br />interpretation that an application for a conditional use permit and comprehensive plan <br />amendment for this project are not required and therefore have not been advertised. If the <br />Council feels differently, a future public hearing on the application for a conditional use permit <br />. and comprehensive plan amendment could be scheduled. <br /> <br />Section 1012.10 lists height limitation exemptions including church spires. Section 1013.02A, <br />indicates that where there are practical difficulties or unusual hardships in the way of carrying <br />out the strict provisions of the code, the City Council may vary provisions in the code in <br />harmony with the general purpose and intent thereof and may impose additional conditions as it <br />considers necessary so that the public health, safety, and general welfare may be secured. <br /> <br />1 <br />
