Recently enacted State Statutes establishing a 60 day time limit for <br />agency review of land use related applications also require cities to provide written notice as to <br />the application's completeness within 10 days of receipt of application. <br /> <br />Your application seeks to rezone the property from R-1 residential to Planned Unit Development <br />which seems to be the appropriate fonn of application given the nature of the proposed private <br />street without dedicated right-of-way. I have enclosed a copy of the planned unit development <br />chapter of the City zoning code outlining required submissions and necessary meetings and <br />hearings. I have also included a second copy of the subdivision regulations to assist your <br />surveyor and engineer in preparing materials for these development review meetings. <br /> <br />At the staff review meeting to determine the application completeness, it was detennined that in <br />addit~on to submittal requirements contained in the planned unit development and subdivision <br />chapters of the City code, the following questions need to be addressed: <br /> <br />l. This is an application for a subdivision. The applicant needs to define right-of-way. If <br />private roads, a planned unit development application is the only review opportunity. <br /> <br />2. Lot 3 does not meet lot depth requirements. <br /> <br />3. Lot 4 does not meet width requirements. <br /> <br />4. Where will stonn water be retained. Can the pond be expanded. <br /> <br />5. Code does not provide for drainage from a private street into a public street. Stonn water <br />runoff plan must be provided. <br /> <br />6.
