Given the actions and
positions of the City and the County, we have been
effectively prevented from pursuing either alternative.

In our view, the City and the County have, by their
statements and actions, effectively prevented us from
realizing any real benefit from our property and by reason
thereof have directly and substantially interfered with our
property rights. Under the circumstances, and based upon
the fact that we have patiently waited for over two and one-
half years for some appropriate action relative to the
foregoing matter, we now feel compelled to demand that the
City and/or the County institute appropriate eminent domain
proceedings to take our property. In the event such action
is not forthcoming within thirty days following the date of
this letter, then we will be forced to bring action for a
writ of Mandamus to compel condemnation.

In the event there are questions concerning the foregoing,
or should you wish to discuss this matter with me in greater
detail, please feel free to call me at your convenience.

Very truly yours,

TH~~~

c.
