<br />CITY OF ROSEVILLE <br />PLANNING REPORT <br /> <br />DATE: 08-14-96 <br /> <br />CASE NO.: 2852 <br /> <br />Deparbnent Approval: <br /> <br />Agenda Section: <br /> <br />Planner Approval: <br /> <br />Item Description: <br /> <br />6(f) <br />An ordinance amending the Roseville City Code Section 1013 clarifying <br />procedure and timing for conditional use permits and variances. <br /> <br />Background <br /> <br />The Planning Commission has previously reviewed and recommended an ordinance to make the Council <br />public hearing on zoning amendments optional because of the 60 day review and decision limit imposed <br />by the State Legislature. At the time, City staff stated that there was a need to review other sections of <br />the ordinance to insure that there was one consistent public hearing notice and hearing process for all <br />zoning related matters. Attached is a draft ordinance which would change the ordinance section <br />concerning conditional use permits and variances in order to have a consistent public notice and hearing <br />process. <br /> <br />Specific Details of Ordinance: <br /> <br />The proposed draft ordinance includes the following: <br /> <br />1. There will be only one required public hearing concerning conditional use permits and variances <br />and that shall be held by the Planning Commission. The City Council may, at its option, hold a <br />public hearing concerning conditional use permits. <br /> <br />2. Approved conditional use permits must be recorded with the Ramsey County Recorder prior to <br />the issuance of any building permit or within 60 days after approval, whichever is less. <br /> <br />3. Mailed notice of variance related public hearings will be sent to property owners within 350 feet <br />of the site instead of within 250 feet of the site. <br /> <br />4. The membership of the Minor Variance Committee is clarified. <br /> <br />Summary and Conclusion: <br /> <br />Staff recommends that this item be approved and sent on to the Council for a first reading on August 26, <br />1996, with any additions/corrections from the Planning Commission. <br /> <br />Suegested Planning Commission Action: <br /> <br />Motion to recommend approval of an ordinance amending the Roseville City Code Section 1013 <br />clarifying procedure and timing for conditional use permits and variances as per the draft ordinance with <br />the following conditions (if any). <br /> <br />Staff Report by: Dennis Welsch <br /> <br />1 <br />
