<br />Draft 7/25/96 <br /> <br />(Underline means new) <br />(Strikeout means delete) <br /> <br />Ordinance Number <br /> <br />AN ORDINANCE AMENDING CITY CODE SECTION 1013 CLARIFYING <br />PROCEDURE AND TIMING FOR CONDITIONAL USE PERMITS AND VARIANCES <br /> <br />The City Council of the City of Roseville does ordain: <br /> <br />I. <br /> <br />City Code Section 1013.01C shall be amended as follows: <br /> <br />C. Procedure for Conditional Use Pennit: Any owner of land may file an application for a <br />conditional use permit by paying the amount set forth in Section 1014.03, providin~ a <br />cOII\Plete awlication and suwortin~ documents as set forth in the standard Community <br />Development D~artment apJ>lication fonn. and by providing the City with an <br />abstractor's certified property certificate showing the property owners within three <br />hundred fifty feet (350') of the outer boundary of the parcel of land on which the <br />conditional use pennit is requested. A hearin~ shall be held on the application 3ftttl1 then <br />bt; hc8fd by the Planning Commission, then by the C6t:lDCil, upon the same published <br />notice, mailing notice and hearing procedure as set forth in Chapter 1015 except that the <br />notices shall contain the description of the land and the kind of conditional use pennit <br />involved. Mid :furtht:r the applicati6ft -;/ill be referred directly by the City MMlRgcr t6 the <br />Plfl:nfl:iftg C6mmissi6n. Within the time limits stipulated in Minnesota Statutes 15.99 (60 <br />day Review and Decision Limit). the City Council may also hold a hearin~. The Council <br />shall decide the method of notification. <br /> <br />II. <br /> <br />Section 1013.01F through G shall be amended as follows: <br /> <br />F. The City Council may attach reasonable conditions to the conditional use pennit. The <br />addition of such conditions shall constitute a finding that the conditions are necessary and <br />reasonable. <br /> <br />~ The apJ>licant shall record ap.vroved conditional use pennits with the Ramsey County <br />Recorder prior to issuance of any buildin~ pennit or within sixty (60) days after approval. <br />whichever is less. <br /> <br />J :\char\wp\resoluti\subdivi,ord <br /> <br />1 <br />
