<br />Air Emission Permit No. 12300387-9 <br />Page 15 of22 <br /> <br />7.7 Amendments and Modifications <br /> <br />A Permittee with an existing permit may at any time during the term of that permit request that it <br />be amended. In addition, pursuant to subp. 14, no modification, as defined in Minn. R. <br />7007.0100 (Definitions), may be made to a stationary source that is required to have a permit, <br />unless the modification is allowed under Minn. R. 7007.1250 (Insignificant Modifications), or <br />7007.1350 (Changes which Contravene Certain Permit Terms), or an amendment is obtained <br />under Minn. R. 7007.1450 (Minor and Moderate Permit Amendments), or Minn. R. 7007.1500 <br />(Major Permit Amendments). Administrative changes to a permit issued under this chapter shall <br />be made under Minn. R. 7007.1400 (Administrative Permit Amendments). If a change at a <br />facility does not constitute a modification, no permit is required. <br /> <br />· Installation of Air Pollution Control Equipment and Replacement of Emission Units <br /> <br />The Permittee may, after providing written notice to the MPCA at least seven working days <br />prior to installation or replacement, install air pollutien control equipment or replace an <br />emission unit described in this permit with one that does not increase emissions of any <br />regulated pollutant. The Permittee and the MPCA shall attach the written notice to their copy <br />of this permit. <br /> <br />If the MPCA finds that the installation or replacement triggers new monitoring, <br />recordkeeping or reporting requirements under applicable requirements or <br />Minn. R. 7007.0100 to 7007.1850, the MPCA shall initiate an amendment under <br />Minn. R. 7007.1400 or 7007.1500, to include the new requirements. <br /> <br />If the installation or replacement constitutes a modification, this item does not apply and the <br />Permittee shall follow the applicable procedures of Minn. R. 7007.1250, 7007.1350, <br />7007.1450 or 7007.1500. <br /> <br />If notice is provided as required by this item, the installation and operation of the additional <br />equipment shall not be considered a violation of the permit. <br /> <br />· Insignificant Modifications <br /> <br />Recordkeeping. The Permittee shall maintain records describing any modification made at <br />the stationary source under Minn. R. 7007.1250 (Insignificant Modifications). The record <br />shall also include calculations of the emissions increase as required by Minn. R. 7007.1200 <br />(Calculating Emission Changes for Permit Amendments), and a statement of the purpose for <br />making the modification. <br /> <br />Notification. If an insignificant modification together with other insignificant modifications <br />made during the course of the permit term, have resulted in total increases of a pollutant in <br />excess of the amounts listed below, the Permittee shall notify the AQD in writing within <br />seven working days after beginning actual construction of the last modification. The notice <br />shall include the information required to be kept above, a certification by a responsible <br />official consistent with Minn. R. 7007.0500, subp. 3, and a statement that the modifications <br />listed were not part of a single project as described in Minn. R. 7007.1250, subp. 5. This <br />notice must be submitted with Part 11 of this permit. <br />
