At the November 26th meeting the Council continued the hearing and action on <br />the Twin City Mack Truck vacation request until December 16th so that further <br />research could be done by the staff and the City Attorney on the correct <br />procedure. <br /> <br />. In his December 3, 1996 correspondence, City Attorney Bell recommended that, <br />by state statute, road vacations can have no site improvement conditions <br />attached. He recommended that the Council rescind resolution 8448 because of <br />the conditions attached and because the work was never completed or filed with <br />the County, In addition; the City Attorney recommended thattheCouncil <br />complete the Mack Truck hearing and' adopt a new vacation 'resolution without <br />site improvement conditions. However, the city may retain utility easements. <br /> <br />Historical Background: <br /> <br />Twin City Mack Truck has requested the City of Roseville to vacate the north half of <br />County Road C-2 right-of-way, lying east of Long Lake Road/Partridge Road and west <br />of 135W along their south property line. No street improvements exist in this right-of- <br />way, although water and storm sewer utilities exist in the right-of-way. In 1989, <br />Rosedale Chevrolet, in concert with Twin City Mack Truck, petitioned the City to vacate <br />the north and south portions of the County Road C-2 right-of-way in this area. At the <br />time, Rosedale Chevrol.et planned to purchase the property from Twin City Mack Truck <br />and expand their car sales lot. <br /> <br />In 1989, the City Council adopted a resolution (#8448) vacating that portion of County <br />Road C-2 right-of-way in favor of Rosedale Chevrolet and Twin City Mack Truck, <br />subject to certain conditions including site improvements for the Rosedale Chevrolet <br />property. Rosedale Chevrolet indicated that the costs of the required improvements <br />made the vacation prohibitive and have not completed the requirements to date. <br /> <br />Development Review: <br />. County Road C-2 is centered on the south line of the northeast quarter of <br />Section 5, T29. R23. The basic county road system was established by <br />maintaining the right to use 2 rods (33 feet) on either side of section lines for <br />road purposes. <br />
