<br />Engineering Considerations: <br /> <br />The Engineering staff has reviewed this application and have indicated that before the <br />vacation can be finalized, the following issues must be resolved: <br /> <br />1. <br /> <br />2. <br /> <br />3. <br /> <br />4, <br /> <br />.' ' 5: <br /> <br />There are back assessments in the amount of $2,032.54 which must be paid. <br /> <br />The County Road C-2 right-of-way currently serves as a parking area for the <br />employees of the adjacent businesses. As part of the right-of-way vacation, <br />Mack Truck Sales and Service will be required to close off the driveway entrance <br />to vacated land from Long Lake Road. A separate driveway permit will be <br />required from Mack Truck <br /> <br />The legal description and boundary survey should be corrected to reflect the <br />actual right-of-way that remains. There was a portion of the right-of-way vacated <br />by MnDOT prior to this application. <br /> <br />As part of the site improvement process, the proposed ponding area should be <br />equipped with an emergency overflow to protect the adjacent property from <br />flooding. <br /> <br />Only vacate the road easelT1ent; a ,20' drain"age;aAd ,utility easement must be <br />retained on this site. ' <br /> <br />Staff Recommendation: <br /> <br />Based on the ability to put property that will not be used for road purposes into <br />productive, taxable use and based on Twin City Mack Truck's willingness to make site <br />improvements that comply with current design standards, staff recommends approval of <br />Twin City Mack Truck's request for the vacation of the north half of County Road C-2 <br />right-of-way, lying east of Long Lake Road/Partridge Road and west of 135W subject to <br />the following condition: <br /> <br />1. A 20 foot utility and drainage easement be should be granted and retained on <br />this site. <br /> <br />Further, the staff recommends that the following conditions be attached to the grading <br />permit and driveway permit necessary for making the proposed improvements to the <br />site: ' <br />1. <br />2. <br /> <br />3. <br /> <br />The required deferred assessments must be paid. <br />The concrete curb and gutter must be installed around the perimeter of the <br />existing and new parking areas. <br />The driveway entrance on Mack Truck property to the County Road C-2 right-of- <br />way, from Long Lake Road, must be closed with concrete curb and gutter <br />installed by the applicant. The city will close the Rosedale Chevrolet portion of <br />the C-2 right-of-way. <br />
