A decision on the need for an Environmental Impact Statement (EIS) <br />must now be made in accordance with the standards and procedures of part 4410.1700. <br /> <br />An EIS must be ordered if you find that the project has the potential for si~nificant <br />environmental effects. In making this decision you must compare the impacts that may be <br />reasonably expected to occur with the following criteria: <br />A. The type, extent, and reversibility of effects; <br />B. The cumulative potential effects of related or anticIpated future projects; <br />C. The extent to which effects can, be mitigated by ongoing public regulatory <br />authorities; and . ' <br />D. The ext~nt to which effects can be anticipated and controlled as a result of other <br />studies undertaken by public agencies or the project proposer, or of-previous EISs. <br /> <br />In making the EISdecision the following procedural requirements must be met: <br /> <br />1. The time frame for the decision depends upon whether ,the decision will be made by a <br />single individual Qr by a council, .board,or other body that meets only periodically. If by <br />an individual, the decision is to be made within 15 working days of the expiration of the <br />ccrrUTIer.t pericd.' If by a body that flH;t:is only periodically, the decision IS to be ,made at <br />the first meeting held'between three and 30 days after the close of the Comment period. <br />These time frames may be extended for the reason cited in item 3 below.' <br /> <br />2. You must maintain a written record of some sort, including specific findings of fact, <br />which supports your decision. The record must include specific responses to all . <br />. substantive, timely comments received on the EA W. <br /> <br />3. If you determine that you lack information which is critical to a reasoned decision about <br />. the potential for or the significance of any possible environmental effects, you must <br />proceed in one of two ways. Either way requires a different notification process as <br />outlined in points 4 and 5. <br /> <br />a. You must postpone the decision on the need for an EIS for up to 30 days so that you <br />
