<br />J~10 <br /> <br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />t Approval: <br /> <br />DATE: 05-28-96 <br />ITEM NO: G- 8 <br />Manager ~,.V;<!y- Agenda Section: <br />'--0 ,'-6 Hearings <br />ESTABLISHMENT OR EXPANSION OF CHURCHES AND <br />SCHOOLS BY CONDITIONAL USE PERMITS IN "R-l" AND <br />"R-2" DISTRICTS. <br /> <br />Item Description: <br /> <br />Background <br />Attached is a draft of an ordinance that would require churches and schools to <br />follow the provisions of a conditional use permit (and hearing) when establishing <br />such a use in an "R-l" or "R-2" zone. The attached map illustrates that there are <br />over 30 sites encompassing more than 260 acres of schools and churches which <br />have boundaries adjacent to residential areas. <br /> <br />The Planning Commission previously recommended that the city have more review <br />opportunity particularly when existing schools and churches expand in residential <br />districts. Churches and schools used to be smaller and more neighborhood and <br />pedestrian oriented. Today there are fewer but much larger facilities that draw <br />participants from a larger area, creating more traffic, requiring large parking lots. <br />These uses are still considered a permitted use, with no formal review process in <br />residential districts. This has caused numerous problems with neighborhoods who <br />find that housing (and their "feeling of neighborhood") is being replaced by parking <br />lots and oversized structures, without an opportunity to be heard on the topic unless <br />a variance is requested. <br /> <br />The draft ordinance simply shifts churches, schools, and similar buildings from the <br />"permitted use" category to the "conditional use" permit category in each residential <br />zone. The establishment or expansion of churches and schools are then subject to a <br />public hearing and the city's design standards. <br /> <br />Alternatives: <br />One alternative for the Planning Commission to consider would be to create a new <br />zoning district for churches, schools, parks, open space, and cemeteries called an <br />Oil zoning district (Open Spacellnstitutional Use) wherein churches, schools, and <br />cemeteries would be conditional uses; parks and open space would be permitted <br />uses.
