Westwood claimed that they should be exempt from curb <br />and gutter around their parking lot and driveways. Further, they claimed they had no <br />parking lots, only narrow private driveways. <br /> <br />The planning staff and Planning Commission determination was that both the drives <br />and parking areas should have curb/gutter as the site is repaved. <br /> <br />The Council's decision was as follows: <br /> <br />In existing townhome and apartment sites, where a parking lot and/or driveway is being <br />rebuilt or repaved, only the parking lot is subject to Section 1004.01d3c, which requires <br />that "concrete curb and proper setbacks will be required if the parking lot is regraded or <br />reconstructed with one inch (1") or greater of bituminous pavement ..." The staff <br />assumes this decision applies only to existing townhome and apartment projects which ~ <br />are being repaved but not those expanding their lots or drives. /~ <br /> <br />In the case of Westwood Village III Homeowner's Association, the Council determined <br />that the paved surfaces between the garages and the landscaped berm parallel with <br />County Road "C" was a driveway only, and therefore rnrt subject to the parking lot <br />curb/gutter requirements of Section 1004.01d3c. A building permit for repaving this ~ <br />driveway may be issued by the Community Development Department when the ______.
