Agenda Section:
Reports and
Recommendations
Westwood Village III appeal of staff interpretation of Section
1004.01d of the City Code requiring concrete curb and gutter
In parking lots.

Background:

This is an appeal of zoning code interpretation.

In the Spring of 1997, the homeowners association for the Westwood Village III (38
town homes) , would like to resurface their driveway/parking lot. In preparing for this, the
homeowner's association board members met with Engineering staff to discuss the
project. During that meeting, it was pointed out that the City Code. requires concrete
curb and gutter around the periphery of parking .Iots and that when resurfacing projects
for existing parking lots are contemplated, this design standard applies, The
homeowners association is requesting an appeal (or second opinion) of that
interpretation from the Planning Commission and City Council.

Development Summary:

Westwood Village III is located in an "R-6" town home ,zoning district.

Section 1004.01d3c states that concrete curb and proper'setbacks will be required if
the parking lot is regraded or reconstructed with a 1 inch lift or greater of bituminous
pavement, [except;,

1.
2.
3.

I "n': R, "'1't'an"dVR"'2&"d','s' 't'r'lc.t.s"*,
../". ~; '\;..:. , ""-' ~,!>A;, _ ' . , ..

i~atkih'g0Iotrse'a.,j,;~~~1~d#konl$'t!lflfa~J1rLeatetJ..
MinOt!pitcnin'g~~'or$snFfa"e'Bwtelfaif!l{ovejila1$flesJftl1a'n~'215'916')",

Section 1010.06 in the design standards chapter of the zoning code states that the
periphery of parking areas and drives shall be constructed with poured in place
concrete curbing. The requirement for concrete curb and gutter at the time of parking
lot repair and resurfacing is meant to bring older facilities into compliance with the
design standards chapter of the zoning code.

1
