You informed me of the following facts: Westwood Village has sought a permit to resurface an area which is used for driveway and/or parking lot. The request for the permit apparently was denied by the building department pursuant to the regulations in Chapter 110 (Design Standards Regulations) . Westwood Village has now informed you that they want to appeal the decision of the building department to the City Council. Clearly the applicant has the right to appeal denial of the permit to the City Council. See Roseville Code 904.04. The City Council's function in determining this appeal is not to consider any policy matters. It is only to determine whether the building department was or was not correct in denying the permit. You also inquired about the regulations imposed by various provisions of the Roseville City Code dealing with maintenance of parking lots. We both agreed that there is some ambiguity in the various Roseville Code provisions dealing with the resurfacing of parking areas. * Also Admitted in Wisconsin tCivil Trial Specialist, Certified by the Civil Litigation Section of the Minnesota State Bar Association.
