<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 12-16-96 <br />ITEM NO.: F-3 <br /> <br />Item Description: <br /> <br />Agenda Section: <br />Reports and <br />Recommendations <br /> <br />Westwood Village III appeal of staff interpretation of Section <br />1004.01 d of the City Code requiring concrete curb and gutter <br />in parking lots. <br /> <br />Manager Received: <br /> <br />~~ <br /> <br />Department Reviewed: <br />j)~~ <br /> <br />Background: <br /> <br />This is an appeal of zoning code interpretation. <br /> <br />In the Spring of 1997, the homeowners association for the Westwood Village III (38 <br />townhomes), would like to resurface their driveway/parking lot. In preparing for this, the <br />homeowner's association board members met with Engineering staff to discuss the <br />project. During that meeting, it was pointed out that the City Code requires concrete <br />curb and gutter around the periphery of parking lots and that when resurfacing projects <br />for existing parking lots are contemplated, this design standard applies. The <br />homeowners association is requesting an appeal (or second opinion) of that <br />interpretation from the Planning Commission and City Council. <br /> <br />Development Summary: <br /> <br />Westwood Village III is located in an "R-6" town home zoning district. <br /> <br />Section 1 004.01 d3c states that concrete curb and proper setbacks will be required if <br />the parking lot is regraded or reconstructed with a 1 inch lift or greater of bituminous <br />pavement, except: <br /> <br />1. In R-1 and R-2 districts. <br />2. Parking lot seal coated or surface treated. <br />3. Minor patching or surface repair (overlay less than 25%), <br /> <br />Section 1010.06 in the design standards chapter of the zoning code states that the <br />periphery of parking areas and drives shall be constructed with poured in place <br />concrete curbing. The requirement for concrete curb and gutter at the time of parking <br />lot repair and resurfacing is meant to bring older facilities into compliance with the <br />design standards chapter of the zoning code. <br /> <br />1 <br />
