<br />3) construct a right turn lane from Cleveland onto County Rd. "D"; <br /> <br />The Developer will not be required to pay for any necessary rights-of-way and <br />construction/ expansion of the interstate ramps to provide queuing capacity. The <br />Developer shall only be required to pay for items 1, 2, and 3 above if the <br />City/County/State begin construction within a reasonable time but in no event <br />beyond January 1,2000. <br /> <br />35. Pending approval by the City and County, the developer and/or a service <br />district may be required to pay for or construct a Cleveland Avenue center island <br />with 2 to 3 gaps for left turns. The island and both edges of the Cleveland <br />Avenue frontage may be landscaped and planted with flowers similar to <br />Lexington Avenue in St. Paul. The Developer shall only be required to pay for the <br />above mentioned improvements to Cleveland Avenue if the City/County begin <br />construction within a reasonable time but in no event beyond January 1, 2000. <br /> <br />36. For 1998 and 1999, the developer and/or a service district or special <br />assessment to developer shall be required to annually pay for "city service <br />credits" to be used or "spent", with advice from the neighborhood . The service <br />credits shall be a maximum of $10,000 per year and shall be invoiced to the <br />developer on a quarterly basis. Such service credits shall be exclusively for <br />police services hours. <br /> <br />37. After an engineering and fire/life safety study, Brenner may be modified to <br />reduce cut through traffic. This will be a city project at City cost. <br /> <br />38. The City shall allow 619,600 s.f. of new buildings on the entire site. <br />Changes in building size or height from the original, approved plan of April <br />11,1997, may only occur south of Lydia where building height may be reduced <br />and single story buildings may be consolidated into vertical building height of up <br />to 8 stories provided: <br /> <br />1) green space on the site is increased to at least 25% of total lot <br />area. <br />2) structured, ramped, or deck parking shall be provided when <br />additional parking space is needed. <br />3) the building is sprinklered to increase fire safety and reduce fire <br />protection costs. <br /> <br />39. Based on the approved (April 11 , 1997) building placement and usage of <br />the lots north of Lydia, an advisory neighborhood design task force shall be <br />formed to review landscaping and lighting plans, street widths and driveway <br />placements, street alignment/realignments and turning movements along and <br />abutting Cleveland Avenue to the business park building setback lines,submitted <br />or proposed after the formulation of the task force, in the area from Lydia <br />Avenue north to and including County Rd. "D" as illustrated in Exhibit H. The task <br />force shall be formed using the City's task force policy - similar to other <br /> <br />8 <br />
