<br />considered a major amendment to the Planned Unit Development and shall <br />require amendment hearings and approval by the City. <br /> <br />27. There shall only be one additional curb cut placed on Cleveland Avenue <br />as a driveway exit from the far southeast corner of the plat, adjacent to the city <br />ponding area. The curb cut permit shall be subject to Ramsey County approval. <br />The business park shall use the existing three roads as entrances to and from <br />Cleveland Avenue. <br /> <br />28. Consistent with paragraph #7, the roads shall remain in the same location. <br />The building(s) within Lot 3, Block 3, shall be redesigned to minimize the visual <br />impact of the loading areas on the adjacent residential area to the east. <br /> <br />29. In the business park, the hours for construction, snow and trash removal, <br />truck deliveries and pickup of materials shall be restricted to normal business <br />hours (7 AM to 10 PM on any weekday and 9 AM to 9 PM on any weekend or <br />legal holiday). <br /> <br />30. The Staff shall review and may approve pathway realignments and city <br />pathway plans to match pavements and provide a continuous pathway. <br /> <br />31. Bar space (in square footage) and hours of operation shall be defined in <br />the bar's liquor license. (See # 25.) Bar and restaurant activities shall be limited <br />to indoor and outdoor eating areas. No outdoor bars or sports activities <br />associated with the bars shall be permitted. Retail bar space shall be prohibited <br />in hotels. <br /> <br />32. Lot 4 of Block 1 of Centre Pointe 2nd Addition (northern most lot of new <br />plat) shall be designated for one story office building use only, with uses as <br />specified in E-2. <br /> <br />33. The developer and/or a service district or special assessment to <br />developer, depending on authorization of the property owners and approval of <br />the City Council, may be required to pay for or construct sidewalks, berms, and <br />screening/walls along the east side of Cleveland Avenue from County Rd. "D" to <br />Lydia. All improvements shall be constructed to meet the City Code Design <br />Standards. <br /> <br />34. The developer and/or a service district or special assessment to <br />developer shall pay for and/or construct (subject to City, County, and State <br />engineering and landscaping approvals) the following: <br /> <br />1) a continuous right turn lane along the west side of Cleveland, from <br />"D" to North Centre Pointe Drive; <br />2) a ramp turning lane from 1-35W north onto County Rd.
