The zoning code affecting the premises is Planned unit <br />Development under Planned unit Development #1177 Agreement <br />(Planning File 2880), a copy of which is attached hereto as <br />Exhibit A. <br /> <br />2. The Project and its proposed use as a 3-story Residence Inn <br />hotel containing 108 rooms will comply with the applicable <br />zoning codes, city ordinances and building, health, fire, <br />sanitation, environmental and energy codes, ordinances and <br />regulations, when constructed in accordance, with approved <br />plans. Plans submitted and approved in connection with <br />issuance of Building Permit A97-340 were consistent with the <br />requirements of the PUD. Compliance of the Project with the <br />foregoing regulations upon completion of construction will be <br />evidenced by the issuance of a final Certificate of Occupancy <br />by the City of Roseville for the Project. <br /> <br />3. There are no variances, conditional use permits or special use <br />permits required for the construction of the improvements on <br />the Premises or its uses except the PUD Agreement referenced <br />in paragraph 1 above. <br /> <br />4. The Premises comply with applicable subdivision ordinances. <br />
