The development will consist generally of approximately <br />1.480,266 square feet of land for Business Park facilities and related improvements (the <br />"Improvements") to be located on the land described on Exhibit A hereto (the "Land") (the <br />Improvements and the Land are referred to herein together as the "Project"). To assist the Bank <br />in determining whether to make the requested loan, the undersigned is providing the following <br />information with respect to the Project: <br /> <br />1. The Land is zoned Planned Unit Development #1177. <br /> <br />2. The intended use of the Project for office purposes is permitted under the City's zoning <br />codes, ordinances and regulations: <br /> <br />Yes. Ordinance 1177 rezoned the property to a PUD and authorized the execution <br />of Planned Unit Development #1177 Agreement. This agreement outlines the <br />requirements for development of the Property and allows development of office <br />facilities. <br /> <br />3. There are no variances, conditional use permits or special use permits required for the <br />intended use of the Project. <br /> <br />No. Additional permits are not required if the Project is developed in accordance <br />with the Planned Unit Development #1177 Agreement, a copy of which is attached. <br /> <br />4, The Land complies with the City's subdivision, ordinances and regulations and may be <br />conveyed without the filing of a plat or replat. <br /> <br />Yes.
