<br />plat except that the Seller shall agree to sign documents necessary for recording such plat. Buyer <br /> <br />agrees to purchase from Seller the Property owned by Seller contained within the final plat. <br /> <br />Inspection. Testing and Surveying. Seller shall allow Buyer and Buyer's agents access to <br /> <br />the Property without charge and at all reasonable times for the purpose of Buyer's investigation, <br /> <br />testing and surveying the same. Buyer shall pay all costs and expenses in such investigation, <br /> <br /> <br />testing and surveying and shall hold Seller and the Property harmless from all costs and liabilities <br /> <br /> <br />relating to Buyer's activities. Buyer shall further repair and restore any damage to the Property <br /> <br /> <br />caused by or occurring during Buyer's testing and return the Property to substantially the same <br /> <br />condition as existed prior to such entry. <br /> <br /> <br />Soil Testing Contingency. The Buyer shall have 30 days from the date of this Agreement <br /> <br /> <br />to perform soil tests to determine suitability for building sites, for hazardous wastes and toxic <br /> <br /> <br />substances. Ifthe tests indicate that the soils are unsuitable for constructing the building units as <br /> <br />described on the approved preliminary plat application or that toxic substances or hazardous <br /> <br />wastes exists on the Property, the Seller shall provide Buyer a credit against the purchase price in <br /> <br />an amount necessary to make the soil corrections or remove the toxic substances 'or hazardous <br /> <br />waste, to Buyer's satisfaction, or the Buyer may cancel this Agreement and all option money <br /> <br /> <br />paid shall promptly be refunded to the Buyer. <br /> <br /> <br />Hazardous Waste. Seller hereby represents and warrants to Buyer that they have neither <br /> <br /> <br />caused, permitted or have any knowledge of any storage, disposal, or dumping of toxic <br /> <br />substances or hazardous waste on the Property in violation of Federal or State law. <br /> <br />~. Seller shall be responsible, at Seller's expense and at no expense to Buyer, of <br /> <br />capping any wells located on the Property. <br /> <br />2 <br />
