<br />City of Roseville <br />Page 3 <br /> <br />Section 14.040 Flashing Signs Prohibited <br /> <br />This section involves signs giving off intermittent or rotating beams. <br />Included in this section are changeable message signs which are allowed <br />to have electronically programmed messages so long as they are not <br />changed more than once every 24 hours, time and temperature excepted. <br /> <br />The Rosedale Square premise sign is primarily a business identification <br />sign. A portion of the sign (approximately 25% of the message area) does <br />provide changeable messages that are programmed for that business day, <br />or week, or month, at owners discretion. The sign also provides time and <br />temperature. Since all changeable message signs provide programmed <br />messages, it is reasonable to assume that permit approval was granted by <br />the City to allow daily, weekly, or monthly messages to be programmed. <br />That is what this sion does. A program is initiated and it runs for that day, <br />or that week, or that month, depending upon needs of the property owner <br />or property tenants. <br /> <br />The underlying purpose of Section 14.040 is presumably to avoid the <br />creation of traffic hazards by signs that flash repeatedly. This sign is!lQ1 a <br />-flashing- sign in that sense. <br /> <br />Based on these facts, we respectfully disagree that this sign is in any manner <br />non-compliant. All parties, including the City, were fully aware of the design, <br />location, and use of the sign. Image Now looked to the City for approval, <br />followed your direction, and obtained the necessary permit.
