<br />City of Roseville <br />Page 2 <br /> <br />4. Image Now always attempts to make very clear the proposed use of <br />the sign for which a permit is being sought. Therefore, a full description <br />of the Rosedale Square sign, including a design drawing and other <br />detail as required by the City was provided. {Copy attached). <br /> <br />You will note that the design drawing portrays a premise identification <br />sign. It is also obvious that the sign is large and that an <br />-interchangeable message center- is approximately a 25% component <br />of the identification statement. This drawing, again, was given to the <br />City when we applied for our permit. <br /> <br />5. The City first notified us by telephone that the proposed sign was <br />approved. This was followed by written approval which arrived on July <br />15, 1996. On that date a letter was received from Gordon Beseth (letter <br />attached) of the City of Roseville stating that the permit was approved <br />but not yet paid for. Mr. Beseth requested our check. We submitted our <br />check the following day. <br /> <br />6. Image Now/Leroy Sign proceeded with fabrication and completed the <br />sign refurbishment in December 1996. <br /> <br />Mr. Jopke, lam sure you realize that it is a complete shock to Image Now, <br />Rreef, C.B. Commercial and Leroy Sign to hear that the Rosedale Square <br />premise sign is now considered non-compliant. Image Now did not in any <br />manner avoid the City's approval--just the opposite, we made sure at every <br />step that the City was involved and approved the sign. The owner (Rreef), the <br />City, and informed citizens all are enjoying an improved business <br />identification sign of great image. <br /> <br />As you can appreciate, Image Now relied upon the City to interpret its own <br />sign codes before approval of a permit. Only after the City approved our <br />permit application was the sign erected. In addition, it is reasonable to agree <br />with authorization of the permit when reviewing the codes. <br /> <br />Section 1009.02 Definition. Advertising Sign <br /> <br />This section states that an advertising sign is a sign which does DQ1 direct <br />attention to a business, its name or address, and is DQ1located on the <br />premises of the business... <br /> <br />The Rosedale Square premise sign obviously is D.Q1 an advertising sign by <br />this definition. The sign ~ direct attention to the business on its premise <br />and it carries the name of these businesses. <br />
