Staff Inte{pretationof Sign Code:

It is the City staffs interpretation that the City Planner properly interpreted the
ordinance, and that the requirement was communicated to the sign company as noted
on the sign application, a copy of which was obtained from the sign company. The
message should be constant (not moving or rolling) on the screen - which was the
intent of this particular ordinance provision.

Staff Recommendation:

1. City staff recommends that the current display be corrected to meet the
requirements of the code - a fixed message (not moving or rolling), changing no
more than once per 24 hours.

2. City staff recommends that the City Council, as the Board of Adjustment and
Appeals, make a final interpretation and direct staff to further enforcement
measures as appropriate.

Council Action Requested:

By motion, interpret the ordinance as requiring a "non moving or rolling message" that
may be changed no more than once in a 24 hour period and direct staff to take the
appropriate further enforcement actions.

Staff Report by: Rick Jopke (490-2241)

J:\CHAR\WP51 CH\RCA\022497B.RCA

2
