<br />[For Pre-Oooing Removals) <br /> <br />ADDENDUM TO OPTION AGREEMENT <br />(RETENTION AND REMOVAL OF BUILDINGS AND IMPROVEMENTS) <br /> <br />This is an Addendum to that certain Option to Purchase and Option to Sell (the <br />"Option Agreement") dated . 1994 by and between <br />("Seller") and the City of Roseville, a <br />municipal corporation organized under the laws of the State of Minnesota ("Buyer"). <br /> <br />RECITALS <br /> <br />A. In the event of a conflict between the terms of the Option Agreement and the <br />terms of this Addendum, the terms of this Addendum shall control. <br /> <br />B. Capitalized terms used in this Addendum and not defined herein shall have <br />the meanings set forth in the Option Agreement. <br /> <br />SECTION ONE <br />WORK TO BE DONE <br /> <br />A. Notwithstanding the provisions of the Option Agreement, Seller is not selling <br />the house, garage and other structures, if any, located on the Property or the <br />(Identify trees, shrubs or any other fixtures Seller <br />intends to retain) (collectively, the "House") to Buyer, and Seller must remove the House <br />from the Property pursuant to the terms of this Agreement. <br /> <br />B. Seller must remove the House from the Property on or before September 1, <br />1997 (the "Removal Date"). The Removal Date shall not be extended for any reason. <br />Seller's obligation to complete the removal of the House from the Property on or before the <br />Removal Date is an essential term of this Agreement. Seller must give Buyer 48 hours <br />advance written notice of the date Seller will commence removal of the House. <br /> <br />C. Seller must remove the House expeditiously, in a good and workerlike manner. <br /> <br />D. Seller must satisfy the following requirements on or before the Removal Date: <br /> <br />1. Before moving the House, Seller must plug the sewer line at house <br />connection and must arrange for water shut off and return of the water meter to the <br />city water facility. All electric, gas and other utility services to the House must be <br />removed by the service company. <br /> <br />2. If removal of the House requires the displacement of any overhead <br />electrical wires, Seller must provide notice to the person, firm, or corporation owning, <br /> <br />351024.2 <br />
