<br />conditions of this agreement. Minor variations from the approved final development plans <br />may be approved by the CITY's Development Review Committee, under the direction of <br />the Community Development Director. Substantial departures from the approved final <br />development plans will require an amendment to the Planned Unit Development in <br />accordance with Section 1015 of the Roseville Zoning Ordinance. Where not superseded <br />by more restrictive requirements of this PUD, the standards of the underlying R-3A <br />(medium density residential) zoning district shall apply, as stated in Chapter 1004 of the <br />Roseville City Code. <br /> <br />6.0 Development of Property <br /> <br />Failure by the DEVELOPER to commence development activity, in accordance with the <br />final development plans, within one year following the final approval of this Planned Unit <br />Development, will necessitate the approval of an extension of the development schedule <br />by the City Council prior to the expiration of the one year period. If an extension is not <br />applied for, the Council may instruct the Planning Commission to initiate rezoning to the <br />original R-1 zoning district. For purposes of this provision, development activity shall be <br />defined as obtaining a building permit and beginning construction on the site. <br /> <br />7.0 Compliance with Laws and Regulations <br /> <br />The DEVELOPER represents to the CITY that the proposed Development will comply with <br />all City, County, Regional, Metropolitan, State, and Federal laws and regulations, including <br />but not limited to the Roseville Subdivision Regulations, the Roseville Zoning Regulations, <br />Rice Creek Watershed Regulations, and all other applicable environmental regulations. <br />The DEVELOPER agrees to comply with all such laws and regulations. <br /> <br />8.0 Subdivision Requirements/Standards <br /> <br />To insure that the proposed plat meets the CITY'S requirements for subdivision approval, <br />as set forth in Title 11 of the City Code, the following provisions shall apply: <br /> <br />8.1 Subdivision of Land. The property shall be subdivided as shown on the preliminary <br />and final plat of Roseville Commons (Exhibit A). Said plat shall include the <br />dedication of 33 feet of right-of-way for County Road C2 along the northern edge <br />of the property and dedication of utility easements as required by the Director of <br />Public Works and shown on the preliminary and final plats attached as Exhibit A. <br />In conjunction with the platting process, the CITY shall release unnecessary utility <br />easements and the existing 33 foot right-of-way easement for County Road C2. <br />The drainage easement shown on the preliminary plat which encompasses the <br />wetland is a private easement and will not be accepted as a public easement. <br /> <br />PUD/Subdivision Agreement #_ (Mendota Homes, Inc.) - Page 3 of 10 <br />
