<br />For two (2) years from the date of this Agreement, no amendments to the CITY'S <br />Comprehensive Guide Plan or official controls shall apply to or affect the use, development <br />density, site layout, or dedication requirements of the land included within the approved <br />plat unless required by state or federal law or agreed to in writing by the CITY and the <br />DEVELOPER. Thereafter, notwithstanding anything in this Agreement to the contrary, the <br />CITY may require compliance with any amendments to the City's Comprehensive Guide <br />Plan, official controls, platting or dedication requirements enacted after the date of this <br />Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD and the final plat for Roseville <br />Commons, the CITY hereby incorporates the following exhibits. The DEVELOPER shall <br />develop the subject property as described or shown in these exhibits. If the exhibits vary <br />from the written terms of this Agreement, the written terms shall control. The exhibits <br />marked as approved by the City Council on February 9, 1998, or as amended thereafter, <br />shall include: <br /> <br />A. Preliminary and Final Plat (Roseville Commons) <br />B. Site Development Plan (Waiting for reduction/not attached) <br />C. Preliminary Grading Plan <br />D. Preliminary Utility Servicing Plan (Waiting for reduction/not attached) <br />E. Landscape Plan <br />F. Building Elevations <br />G. Building Floor Plans <br />H. Project Narrative (John H. Mathern) <br />I. Association Agreement/Covenants (Being finalized/not attached) <br />J. Proof of Parking Documentation (Being finalized/not attached) <br />K. City Street Tree Master Plan <br /> <br />5.0 Rezoning <br /> <br />The CITY conducted hearings and meetings on December 10, 1997 (Planning Commission <br />- hearing on concept development plan), January 10, 1998 (City Council - meeting on <br />concept development plan), January 12, 1998 (Planning Commission - hearing on <br />preliminary plat), January 26, 1998 (City Council - meeting on preliminary plat), and <br />February 9, 1998 (City Council - hearing on final development plan and final plat), to <br />consider various aspects of the Planned Unit Development, including the plat of the subject <br />property and rezoning of the subject property from R-1 Single Family Residential to PUD <br />Planned Unit Development. The CITY agrees to rezone the subject property to PUD, <br />subject to the DEVELOPER's strict compliance with the approved plans, and the terms and <br /> <br />PUD/Subdivision Agreement # _ (Mendota Homes, Inc.) - Page 2 of 10 <br />
