A CONDOMINIUM ROSEVILLE COMMONS CONDOMINIUM OWNERS ASSOCIATION DECLARA TION THIS DECLARATION is made as of this _ day of , 1998, by Mendota Homes, Inc., a Minnesota corporation, herein referred to as "Declarant", pursuant to the provisions of the Minnesota Common Interest Ownership Act, Minnesota Statutes Sections 5158.1-101 through 5158.4-118 (the "Act"), as amended. RECITALS Declarant is the Owner of the following described real property situated in County of Ramsey, State of Minnesota, legally described as, to-wit: See attached Exhibit A. All of which real estate constitutes and is referred to herein as the "Reai Estate". Declarant wishes to establish the Real Estate as a condominium under the Act. NOW, THEREFORE, Declarant declares that the Real Estate is and shall be divided, held, transferred, conveyed, sold, leased, occupied and developed subject to the Act and to tile covenants, conditions, restrictions, easements, charges and liens set forth in this Declaration, whicll shall run with the real estate and binding upon all parties having any right, title or interest in the Real Estate, their heirs, successors, and assigns which shall inure to the benefit of each Unit Owner, and the heirs, successors and assigns of each Unit Owner. Any provisions of the Act (Chpt. 5158) which govern this Common Interest Community. (CIC), and the Minnesota Corporation Act, Minn. Stat. Chpt. 317A, under which the Association is formed, are not repeated in this Declaration. This Declaration should be read in conjunction with both Statutes. ARTICLE I DEFINITIONS Words defined in the Act shall have the meaning described to them in the Act. The following are supplemental definitions. 1. "Association". Shall mean Roseville Commons Condominium Owners Association, a Minnesota corporation. 2. 80ard of Directors. Shall mean the Board of Directors of the Association. 3. Member. Shall mean any person or entity holding membership in the Association.
