<br />3JJ. MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed addition, written statement from the applicant, and written <br />approval from the adjacent property owner affected by the variance (Advent <br />Lutheran Church). <br /> <br />3.2 The Minor Variance Committee reviewed this request on June 2, 1997, and <br />unanimously recommended approval of a minor variance to reduce the front yard <br />setback along the unimproved Dellwood Avenue N to 16.5 feet for the purpose of <br />constructing an addition to an existing dwelling at 1270 Josephine Road N, based <br />on the following findings: <br /> <br />1. Dellwood Avenue N is unimproved in this area and three separate feasibility <br />studies have found that the improvement of this right-of-way would not be <br />feasible because of existing soil conditions. <br /> <br />2. While it is doubtful that this right-of-way will ever be improved, vacation of the <br />right-of-way is somewhat problematic. A recreational trail is located within <br />the right-of-way and provides access to Cottontail Park. In addition, an <br />undeveloped residential lot is located on the east side of Dellwood Avenue <br />between the Willis parcel and Cottontail Park. <br /> <br />3. The addition will be set back 16.5 feet from the west property line, which is <br />greater than the required side yard setback of ten feet in this zoning district. <br /> <br />4. There is no other practical location for an addition to the existing dwelling on <br />the property. <br /> <br />5. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4Jl SUGGESTED ACTION <br /> <br />4.1 By motion, approve John and Diane Willis' request for a minor variance to reduce <br />the front yard setback along the unimproved Dellwood Avenue N to 16.5 feet for the <br />purpose of constructing an addition at 1270 Josephine Road N based on the <br />findings of the Minor Variance Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owner; sketch of property; building elevations; photographs of property. <br />60-day Time Limit: Revised application accepted on May 2,1997; Decision deadline is July 1,1997. <br />Prepared by: Kim L.
