Requirement Proposal Variance Accessory building - 5' setback 4.25' setback .75' (g, variat'1re 2.0 BACKGROUND 2.1 Norman Herauf owns a home at 2797 Churchill Street. The property is zoned R-1 Single Family Residential and all adjacent land uses are single family residential or vacant land. 2.2 Mr. Herauf is requesting a minor variance to bring an accessory building constructed in 1985 into compliance. At the time of construction, Mr. Herauf thought the lot depth was 127.7 feet, with the accessory building set back approximately seven feet from the west property line. Mr. Herauf has recently found that the actual lot depth is only 124.77 feet, with the accessory building set back only 4.25 feet. 2.3 Section 1004.01A, City Code, requires accessory buildings to be located five feet or more from all lot lines of adjoining lots which are in any R district. 3.0 MINOR VARIANCE COMMITTEE 3.1 The request for the variance included the required application form, sketch of the property, and written approval from the adjacent property owner affected by the variance (George Reiling). 3.2 The Minor Variance Committee reviewed this request on May 7, 1997, and unanimously recommended approval of a minor variance to reduce the setback of an accessory building to 4.25 feet for the purpose of bringing an accessory building constructed in 1985 into compliance at 2797 Churchill, based on the following findings: PF#2908 - RCA - Page 1 of 2
