<br />1. A building permit was issued for the accessory building in 1985 and required <br />inspections were performed. <br /> <br />2. It appears that the error in the lot depth measurement was inadvertent rather <br />than intentional. <br /> <br />3. Requiring the accessory building to be moved .75 feet (nine inches) would <br />create a practical difficulty for the property owner. <br /> <br />4. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />5. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4.0 SUGGESTED ACTION <br /> <br />4.1 By motion, approve Norman Heraufs request for a minor variance to reduce the <br />setback of an accessory building to 4.25 feet for the purpose of bringing an <br />accessory building constructed in 1985 into compliance at 2797 Churchill, based on <br />the findings of the Minor Variance Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application/consent form from <br />adjacent property owner; sketch of property; photographs of property. <br /> <br />60-day Time Limit: Application submitted on April 21, 1997; Application accepted as <br />complete on April 28, 1997; Decision deadline is June 27, 1997. <br /> <br />Prepared by: Kim L.
