<br />1. The existing house at 2125 Hamline Avenue N is set back 11 feet from the <br />north property line along Burke Avenue W. The residential structure was <br />constructed in 1927 and the current front yard setback requirement was <br />adopted in 1959. The construction of Burke Avenue W in the late 1950s <br />resulted in this dwelling being classified as a non-conforming. <br /> <br />2. Since the structure does not meet the required 30 foot front yard setback, it <br />is classified as a nonconforming structure. Section 1011.02, City Code, does <br />not allow the expansion of a non-conforming structure. For this reason, a <br />variance is needed in order to remove the nonconforming statu!? of the <br />building and allow the property to be improved. A variance to reduce the <br />front yard setback along Burke Avenue W will bring the structure into <br />conformance with current requirements. <br /> <br />3. The location of the house on the property creates practical difficulty and is <br />a hardship. Because of the nonconforming status of the structure, any <br />addition(s) which would expand the exterior dimensions of the structure <br />would not be allowed. This presents practical difficulty in upgrading and <br />improving the existing residential property. <br /> <br />4. The proposed 18 x 21' addition to the house on this property will be on the <br />west side of the house and will not encroach into established building <br />setback lines along either Burke Avenue W (north side of house) or Hamline <br />Avenue W (east side of house). <br /> <br />5. The addition will provide additional living space on the first floor (family room <br />and bathroom) and an open deck accessed from the second floor. The <br />exterior of the addition will be stucco to match the existing dwelling. <br /> <br />6. The proposed addition will not change the drainage pattern on the property, <br />nor will it divert on to adjacent properties. <br /> <br />7. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />8.
