<br />2.3 A fire rated wall will be required on those portions of the addition that are less than <br />six feet from the detached garage in order to provide adequate fire separation. <br /> <br />2.4 Section 1012.01 BD, City Code, requires a side yard setback of no less than five feet <br />for residential parcels established and recorded prior to May 21, 1959. <br /> <br />M MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed addition, written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Helen Dokken <br />at 2673 Galtier Street N, John Meath at 2687 Galtier Street N, Richard Pettersen <br />at 2678 Galtier Street N, Robert Null at 2686 Galtier Street N, Ann Kees at 2672 <br />Galtier Street N, Joyce McFadden at 2688 Matilda Street N, Herman Strutz 'at 2680 <br />Matilda Street N, and Doug Maltby at 2674 Matilda Street N). <br /> <br />3.2 The Minor Variance Committee reviewed this request on June 2, 1997, and <br />unanimously recommended approval of a minor variance to reduce the side yard <br />setback to two feet for the purpose of constructing an addition to an existing house <br />which will be less than six feet from an existing non-conforming detached garage <br />at 2679 Galtier Street N, based on the following findings: <br /> <br />1. The existing detached garage at 2679 Galtier Street N is set back two feet <br />from the northern side property line. <br /> <br />2. The proposed addition to the house on this property will reduce the setback <br />between the house and the detached garage to less than six feet. In <br />situations where the setback between the principal structure and accessory <br />structure is less than six feet, the accessory structure is considered to be an <br />integral part of the principal structure. <br /> <br />3. The construction of the addition will reduce the side yard setback of the <br />principal structure (house and existing detached garage) to two feet from the <br />northern side property line; however, the addition will not actually encroach <br />into the overall established building setback lines on the property. <br /> <br />4. The addition is needed in order to accommodate the expanded family <br />situation required to care for Mrs. Johnson. <br /> <br />5. There is no other practical location for the addition on the property. <br /> <br />6. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />7.
