<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 06-09-97 <br />ITEM NO: c- 6 <br /> <br />M Agenda Section: <br />Consent <br />Jonathan and Masumi Abeler request for a minor variance at 2339 <br />Roselawn Avenue W (PF#2919). <br /> <br /> <br /> <br />1J1 REQUESTED ACTION <br /> <br />1.1 Jonathan and Masumi Abeler are requesting a minor variance to reduce the front <br />yard setback on a corner lot to 25 feet for the purpose of constructing an addition <br />on a nonconforming two-family residential structure at 2339 Roselawn Avenue W. <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />Front yard setback - 30' <br /> <br />25' setback <br /> <br />5' variance <br /> <br />2JJ. BACKGROUND <br /> <br />2.1 Mr. and Mrs. Abeler own a duplex at 2339 Roselawn Avenue W, which is at the <br />corner of Roselawn Avenue Wand Lake Street N. The property has been zoned <br />R-2 Two Family Residential since 1959 and has historically been occupied as a two <br />family dwelling. Adjacent land uses include single family residential, open space, <br />and a wetland. <br /> <br />2.2 Mr. and Mrs. Abeler are requesting a variance from Section 1 004.03D to reduce the <br />front yard setback along Lake Street N to 25 feet for the purpose of constructing a <br />10' x 24' addition on the rear side of a nonconforming residential structure.. Since <br />the front yard setback of the existing house is less than the required 30 feet from <br />Lake Street N, the house is classified as a nonconforming structure. Section <br />1011.02 does not allow the expansion of a nonconforming structure. For this <br />reason, a variance is needed in order to remove the nonconforming status of the <br />building and allow the property to be improved. The proposed addition will be on <br />the west side of the structure and will not encroach into established building lines <br />along either Lake Street N or Roselawn Avenue W. <br /> <br />2.4 Section 1004.03D, City Code, requires a front yard setback of no less than 30 feet <br />in an R-2 zoning district. <br />I <br /> <br />3Jl MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed addition, proposed building elevation from Lake Street N, <br /> <br />PF#2919 - RCA - Page 1 of 2 <br />
