<br />written statement from the applicant, and written approval from the adjacent <br />property owner affected by the variance (Jack Miller at 2333 Roselawn Avenue W). <br /> <br />3.2 The Minor Variance Committee reviewed this request on June 2, 1997, and <br />unanimously recommended approval of a minor variance to reduce the front yard <br />setback to 25 feet for the purpose of constructing an addition on a nonconforming <br />two-family residential structure at 2339 Roselawn Avenue W, based on the following <br />findings: <br /> <br />1. The existing house at 2339 Roselawn Avenue W is set back 25 feet from the <br />east property line along Lake Street. Since the structure does not meet the <br />required front yard setback, it is classified as a nonconforming structure. <br /> <br />2. Section 1011.02, City Code, does not allow the expansion of a non- <br />conforming structure. For this reason, a variance is needed in order to <br />remove the nonconforming status of the building and allow the property to be <br />improved. <br /> <br />3. The proposed 10' x 24' addition to the house on this property will be on the <br />west side of the house and will not encroach into established building lines <br />along either Lake Street N (east side of house) or Roselawn AvenueW <br />(south side of house). . <br /> <br />4. The addition will provide additional garage space on the first floor and <br />additional living space on the second floor. The driveway will also be <br />reconfigured to enter the garage from the east rather than from the south. <br /> <br />5. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />~o SUGGESTEDACnON <br /> <br />4.1 By motion, approve Jonathan and Masumi Abeler are requesting a minor variance <br />to reduce the front yard setback to 25 feet for the purpose of constructing an <br />addition on a nonconforming two-family residential structure at 2339 Roselawn <br />Avenue based on the findings of the Minor Variance Committee outlined in section <br />3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written consent from adjacent property <br />owner; sketch of property, floor plan, building elevations; photographs of property. <br />60-day Time Limit: Application accepted on May 27, 1997; Decision deadline is July 25, 1997. <br />Prepared by: Kim L.
