Since the Planning Commission meeting, staff has researched alternative City-
owned sites and identified the Gateway Business Park as a viable alternative. A
letter from Julie Kimble, Director of Real Estate Development for OPUS, expressing
concerns with the location of communications tower within Gateway Business Park
is attached.

The applicant is also pursuing the option of co-locating communications facilities on
other existing towers and structures within the community.

fJ1 SUGGESTED ACTION

6.1 It is the Council's policy to accept public comment as time permits.

6.2 By resolution, deny the request for a conditional use permit to allow the placement
of a commercial communications tower on a non-City tower site at 2582 Long Lake
Road, based on the findings outlined in Section 3.1.

6.3 Provide direction to staff on the appropriateness of co-locating communication
facilities on other existing towers and structures (such as electrical transmission
towers, utility poles, and similar structures) within the community. Section 1012.10A
of the City Code, which deals with communication towers, includes an exception
which states, "antennas attached to, but not above, the exterior walls of buildings
as an integral part of the architecture shall be a permitted use in all "B" Business
and "I" Industrial Districts."

Staff is recommending that this section of the ordinance be amended to allow the
location of new communication equipment on existing towers and structures in all
zoning districts within the community as a permitted use. As a permitted use, such
new communication equipment would only require administrative approval and a
building permit.

Attachments: location map; notification map; notice of public hearing; site plan; elevation of monopole;
photograph of similar monopole; service coverage maps with and without this site; non feasibility study for City
tower site; description of CDMA technology; photographs of property; resolution denying request; letter from
Julie Kimble (OPUS).

60-day Time Limit: application submitted on June 9, 1997; application accepted as complete on June 19,
1997; decision deadline is October 17,1997 (extended by City Council on 8/11/97).

Prepared by: Kim L Lee, AICP (490-2236)
M:\RCA\PF2929C.RCA

RCA (PF2929) - 09/22/97 - Page 4 of 4
