4J2 STAFF RECOMMENDA TION

4.1 Prior to the identification of a City-owned site in the area, staff recommended
approval of the request with conditions. Based on the findings outlined in Section
3.1 of this report, staff now recommends that the request for a conditional use
permit be denied because the applicant has not adequately explained why it is not
technically feasible to locate the proposed antenna on a City-owned site. In
addition, the applicant is pursuing the possibility of co-locating its communication
facilities on existing towers and structures within the community.

M PLANNING COMMISSION

5.1 On July 9, 1997, the Planning Commission held a public hearing on the request.
John Hollenbeck, CB Commercial (now with US West), was present to answer
questions and provide additional information. No residents present commented on
this request.

5.2 The Planning Commission discussed the technology being used for this system, the
service radii for this technology, and the technical feasibility of locating the antenna
on a City tower site.

5.3 The Planning Commission recommended approval of the request for a conditional
use permit to allow the placement of a commercial communications tower on a non-
City tower site at 2582 Long Lake Road, based on the findings outlined in Section
3.1 of this report and with the following conditions:

1. The applicant must demonstrate the service area for the proposed antenna
in this location versus a City tower site.

2. The applicant must demonstrate why it is not technically feasible to meet the
requirements of the code and integrate such antennas or add them to an
existing cellular or water tower.

3. The applicant must provide space for up to three additional users on the
proposed tower or demonstrate why it is not technically feasible to do so.

4. The monopole must be setback a minimum of 30 feet the east property line
and a minimum of ten feet from the south property line.

5. The monopole must be removed by the owner within twelve months after it
is no longer in use. A bond may be required from the owner by the city to
assure that the tower is removed within twelve months.

5.4 Information on the availability and feasibility of a City-owned site in the vicinity
(Gateway Business Park) was not considered by the Planning Commission.

RCA (PF2929) - 09/22/97 - Page 3 of 4
