<br />replaced, provided the property is located in an R-1, Single Family Residential <br />District, and used for residential purposes. <br /> <br />2.4 Section 1004.01A, City Code, states, "accessory buildings shall not exceed fifteen <br />feet (15') in height, shall be five feet (5') or more from all lot lines of adjoining lots <br />which are in any R District and shall be six feet (6') or more from any other building <br />or structure on the same lot." <br /> <br />Section 703.04B, City Code, states "residential driveways shall be constructed so <br />that the edge of the driveway nearest to the side lot line shall be a minimum of five <br />feet from the side lot line." <br /> <br />3.J1 MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed garage, written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Jerry and <br />Maureen Ronke at 1311 Ryan Avenue W). <br /> <br />3.2 The Minor Variance Committee reviewed this request on July 8, 1997, and <br />unanimously recommended approval of a minor variance to reduce the side yard <br />setback of an accessory building (detached garage) to one foot for the purpose of <br />replacing an existing single car detached garage (13' x 21') with a two car detached <br />garage (26' x 26'), and a blanket variance to reduce the setback of a residential <br />driveway to one foot to bring an existing driveway at 1303 Ryan Avenue W into <br />compliance, based on the following findings: <br /> <br />1. The existing single car garage and driveway are located approximately one <br />foot from the west property line. The new garage and driveway will not <br />encroach further into the established set back line. <br /> <br />2. There is no other practical location for a garage, either detached or attached, <br />on the property. In order to place the garage five feet from the side property <br />line, the driveway would also need to be moved over four feet. This will <br />require the removal of a mature ash tree and the reconstruction of an <br />existing deck. Because of the proposed location of the garage, the driveway <br />must also be located one foot from the property line. <br /> <br />3. The width of the driveway will not exceed 26 feet at the property line for any <br />of the properties listed. <br /> <br />4. The proposed variances are in harmony with the general purpose and intent <br />of the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />5.
