<br />2.4 Variances within the shoreland management overlay district may only be granted <br />in accordance with Minnesota Statutes, Chapter 462. Subdivision 6(2) of MS <br />462.357 allows variances to be considered when strict enforcement ofthe ordinance <br />would cause undue hardship to the individual property under consideration. "Undue <br />hardship" as used in connection with the granting of a variance means the property <br />in questions cannot be put to reasonable use if used under conditions allowed by <br />the official controls, the plight of the landowner is due to circumstances unique to <br />the property not created by the landowner, and the variance, if granted, will not alter <br />the essential character of the locality. <br /> <br />2.5 The following items are attached: a location map; a letter from Mr. Kueppers <br />regarding this request; a map of this location showing lot dimensions; the lot split <br />originally proposed by Mr. Oren; another proposed lot split configuration; and a copy <br />of MS 462.357. <br /> <br />JJl SUGGESTED ACTION <br /> <br />3.1 Provide direction to the applicant and staff on Mr. Oren's request Alkalai's request <br />to split a parcel of land located at 3150 West Owasso Boulevard into two parcels. <br /> <br />Attachments: location map; letter from Fred Kueppers, Jr.; map with lot dimensions; proposed lot split <br />configurations; and MS462.357. <br /> <br />60-day Time Limit: none. <br /> <br />Prepared by: Kim L.
